Role Responsibilities

Strategy

\xc2\xb7 Have an awareness and understanding of the Group\xe2\x80\x99s business strategy and model appropriate to the role.

\xc2\xb7 Provide inputs in shaping the Country Legal strategic direction.

\xc2\xb7 Responsible to maintain close relationships with stakeholders to provide them with relevant legal advice, guidance and support.

\xc2\xb7 Promote a culture and practice of compliance with legal standards, including conducting business within legal and regulatory requirements, with high ethical standards.

\xc2\xb7 Responsible to provide strategic and where appropriate proactive advice to the relevant business governance fora, on legal and regulatory issues that have a significant impact on the business (and strive to proactively identify such issues), working with external counsel as appropriate.

Business

\xc2\xb7 Responsible to provide legal advice, guidance and support to CPBB and functions across Malaysia on all legal matters.

\xc2\xb7 Partner with other members of the Legal function on, and contribute (where appropriate and without duplication or overlap) to, management of Legal matters even if they do not have direct responsibility for such matters.

\xc2\xb7 Contribute to optimising operating efficiency while balancing the effectiveness of decision making within the Country Legal function.

\xc2\xb7 Support Country Head of Legal and Legal colleagues in developing effective dispute risk management strategies and deploying these strategies in a timely manner across products and channels.

Processes

\xc2\xb7 Act quickly when any risk and control weakness becomes apparent and ensure they are escalated to the appropriate persons and addressed.

\xc2\xb7 Keep supporting the operational efficiency and effectiveness of processes for management of legal papers (court orders, etc) and litigation risks.

\xc2\xb7 Contribute to the management of non-major disputes across the Bank in Malaysia.

\xc2\xb7 Support the Disputes and Government Investigations Legal (DGIL) team in management of major disputes and government investigations in Malaysia.

People & Talent

\xc2\xb7 Lead through example and continuously support the building of appropriate culture and values within the team.

\xc2\xb7 Encourage and promote an active training and learning environment to facilitate excellence in legal risk management, legal risk awareness, behaviours and accountability.

Risk Management

\xc2\xb7 Identify material legal risks in areas under their purview, highlight these to Head, Legal, Malaysia, and work with relevant stakeholders to manage those risks, as necessary.

\xc2\xb7 Within the Group\xe2\x80\x99s Enterprise Risk Management Framework, establish and maintain an appropriate risk-based approach to assessing, measuring, monitoring, managing and reporting Legal Risks arising in their areas of responsibility.

\xc2\xb7 Support Head, Legal, Malaysia in his/her role as Process Owner for any Country processes owned by Legal where executed by the country team. Assist in (i) the management of such processes, and (ii) associated risks, including activities within the processes which are carried out by the businesses or functions, or which are hubbed or outsourced.

\xc2\xb7 Support Head, Legal, Malaysia in his/her role as Risk Framework Owner for Legal Risks arising within the Bank in Malaysia, as set out in the Group\xe2\x80\x99s Enterprise Risk Management Framework.

\xc2\xb7 Maintain an awareness and understanding of the top risks facing the Group and the role played by Legal and each individual in managing them.

Governance

\xc2\xb7 Work with others in the team and other Legal teams to provide oversight on security documentation and litigation management processes, ensuring compliance with the highest standards of regulatory and business conduct and compliance practices, as defined by internal and external requirements. This includes compliance with local banking and securities laws, other applicable laws, and anti-money laundering regulations.

\xc2\xb7 Responsible to embed the Group\xe2\x80\x99s values and code of conduct in security documentation and litigation management processes, to ensure that employees\xe2\x80\x99 adherence with the highest standards of ethics, and compliance with relevant policies, processes and regulations form part of the culture.

\xc2\xb7 Where external counsel is appointed, liaise with external counsel, ensure the scope of work is defined and appropriate, the quality of work is overseen effectively, legal costs are managed, and that there is appropriate overall matter management.

\xc2\xb7 Accountable for satisfactory closure of legal related issues / gaps arising from internal audits, peer reviews and regulatory reviews in areas under their purview.

\xc2\xb7 Maintain a deep awareness and understanding of the regulatory framework in which the Group operates, and the regulatory requirements and expectations relevant to the Legal role.

\xc2\xb7 Take personal responsibility for embedding the highest standards of ethics, including regulatory and business conduct, across Standard Chartered Bank. This includes understanding and ensuring compliance with, in letter and spirit, all applicable laws, regulations, guidelines and the Group Code of Conduct.

\xc2\xb7 Effectively and collaboratively identify, escalate, mitigate and resolve risk, conduct and compliance matters.

\xc2\xb7 Work with Head, Legal, Malaysia to achieve the outcomes in the Bank\xe2\x80\x99s Conduct Principles: Fair Outcomes for Clients, Effective Financial Markets, Financial Crime Compliance, The Right Environment.
